The terms and conditions as set out herein (“Terms”) constitute an agreement between Earthglies, a company incorporated under the laws of India, (“we”, “Earthglies” “us” or “our”), which manages and operates the website www.earthglies.com (collectively referred to as the “Platform”) and a natural or legal person who accesses and/or uses the Platform in any manner (“you” or “your”).

By using the Platform, you expressly agree to be bound by these Terms. If you do not agree with any of the Terms, please do not use the Platform. These Terms govern your use of the Platform and transactions or dealings thereon.

1.3 This document is an electronic record in terms of the Information Technology Act, 2000 and rules made thereunder. This electronic record is generated by a computer system and does not require any physical or digital signatures.

2. REGISTRATION AND ACCOUNT

2.1 To purchase products or avail of services, you may need to set up an account by providing information such as your name, email, mobile number, and shipping address. You represent that the information you submit is truthful and accurate.

2.2 You are solely responsible for maintaining the confidentiality of your login credentials and for all actions undertaken through your account. We will not be liable for any loss or damage arising from your failure to comply with this security obligation.

2.3 By accepting this Agreement, you affirm that you are 18 years of age or above. If you are under 18, you must use the Platform under the supervision of a parent or legal guardian.

3. COMMUNICATION POLICY

3.1 By using the Platform, you consent to receive news, updates, and promotional communications via SMS, Email, or WhatsApp from us or our authorized representatives, even if your number is registered under DND/NCPR.

3.2 You can unsubscribe from marketing communications at any time by following the instructions provided in such messages.

4. OTC PRODUCT POLICY (No Prescription Required)

4.1 Earthglies is a reseller of Over-The-Counter (OTC) products, beauty products, and FMCG goods. We do not sell prescription-only medicines (Schedule H/H1) that require a licensed physician's prescription.

4.2 The information provided on the Platform regarding products is for informative purposes only and does not constitute medical advice. You should always seek the advice of a qualified healthcare professional before using any product purchased from the Platform.

Our products are not intended to diagnose, treat, cure, or prevent any disease. Results may vary from person to person.

4.3 We disclaim any guarantee of exactness regarding the visual representation (images/graphics) of the products compared to the actual product delivered, as packaging may vary based on the manufacturer’s updates.

5. PRICING AND PAYMENTS

5.1 We strive to provide accurate pricing and product specification information. However, errors may occur. In the event a product is listed at an incorrect price, we reserve the right to cancel the order.

5.2 Payments must be made through the integrated secure payment gateways. We do not store your sensitive financial information like CVV or passwords.

5.3 The total price mentioned at the checkout page is inclusive of all taxes and shipping charges (if any). Customers will be charged immediately upon placing the order through our secure payment gateway.

6. RETURN, REFUND, AND CANCELLATION

6.1 Returns: We have a 2-day return policy for damaged, expired, or incorrect products. The product must be unused and in original packaging.

6.2 Refunds: Once the return is approved, the refund will be credited to your original mode of payment within 10 business days. We do not charge any additional return or restocking fees.

6.3 Cancellation: You can cancel your order before it is dispatched. Once shipped, you may refuse delivery to initiate a return and refund.

7. USER WARRANTIES AND RESTRICTIONS

You agree not to:

• Introduce viruses, trojans, or any malicious software to the Platform.
• Use robots, spiders, or scrapers to access the Platform for any purpose.

You agree to indemnify and hold Earthglies harmless from any claims, losses, or damages arising from your violation of these Terms or misuse of the Platform. Earthglies shall not be liable for any indirect, incidental, or punitive damages resulting from the use or inability to use the Platform.

10. FORCE MAJEURE

We will not be held responsible for any delay or failure to comply with our obligations if the delay or failure arises from any cause which is beyond our reasonable control, such as natural disasters, strikes, or internet failures.

11. SEVERABILITY AND WAIVER

If any provision of these Terms is held to be unenforceable, the remaining provisions will continue in full force and effect. No waiver of any term shall be deemed a further or continuing waiver of such term.
